Pollution Control & Wastewater Programs

Whether a new project involving an on-site wastewater treatment system or a modification of an existing operation and wastewater treatment system, the process is essentially the same. The design of new or modification of an existing wastewater treatment system must be performed by an engineer licensed to practice in Kansas by the Kansas Board of Technical Professions. 

The process typically consists of the following steps: 

  • Initial contact with Kansas Department of Health and Environment (KDHE) Bureau of Water (BOW) Industrial Program Unit (IPU) staff
  • Development of a detailed engineering report outlining the project proposal and submission to the IPU for review and approval
  • Submission of a permit application for new projects or a permit application addressing the proposed modifications if required
  • Development of detailed construction plans and specifications to the IPU for review and approval
  • Upon approval of the construction plans and specifications, construction may begin if all other required permits have been secured
  • Certification by a licensed professional engineer that construction was completed in conformance with the KDHE approved construction plans and specifications. 
  • Upon issuance of the wastewater permit and certification of construction, the wastewater treatment system may be placed into service. 

Regulations

The design of wastewater treatment systems shall be in conformance with the Kansas Minimum Standards of Design for Water Pollution Control Facilities (1978) and the Kansas Administrative Regulations (K.A.R.) 28-16-160 thru 28-16-174 effective May 20, 2005, which address provisions regarding the design, construction, operation, and closure of wastewater treatment lagoons. Where provisions of KAR 28-16-160 thru 28-16-17 4 conflict with the provisions of the Minimum Standards of Design, the regulatory provisions shall control.
